Bali Sets up Governor Regulation About Mines & Energy

Bali governor decided to issue regulations related to post-discharge of Law No.23 / 2014 on Regional Government which has delegated authority to the energy and mineral resources of the government to the provincial government.

Bali Governor Made Mangku Pastika insists this decision was made with consideration to avoid cases of illegal mining that could cause conflicts and fatal as in Lumajang, East Java.

After the local government releasing responsibility for the licensing of energy and mineral resources, the central government has not issued a government regulation (PP) which can be used as a reference.

As a result on the field, the current government is not willing to serve licensing and handed over to the provinces.

“If you want to blame, kindly intend it to the central, there was chaos in the area. Regency is out of charge, but now the province has not been able to take over,” he said, Thursday (10/08/2015).

Referring to Law No.23 / 2014 on Regional Government, and Circulation Letter of Internal Affairs Ministry No. 120/253 / SE 2015 and Minister of Energy and Mineral Resources No.4.E / 20 / DFV / 2015, the holding of mineral mining affairs Coal is in the hands of the provincial government. Pastika said the provincial secretary had ordered the governor to formulate regulations despite guidance from the center. He outline that the regulation is urgent consecuently the parties who want to take advantage of circumstances can be anticipated.

Although there is no guideline rule, Bali provincial government will consult with the Ministry of Internal Affairs will remain associated procedures for issuance of the regulation. If not allowed, he added, it would continue to follow and chose to wait.

“It is fine if it is not agreed, at least we have pioneered it, because other regions have not possess it yet. However it is wrong if we are doing nothing,” he explained.

Head of Investment and Regional Licensing (BPMPD) Bali, Ida Bagus Parwata said its party is not currently serve permit application of excavation C and groundwater that the arbitrary has been handed over to the provincial government of Bali. The reason is, there are no rules that can be used as a reference for it.

In addition, local governments actually still have the right to provide consent, as it can be found in circulation letter of Internal Affairs Ministry. Parwata emphasized if the rule is actually forced on 2 October 2016.
